The
following terms and conditions, including those on the face hereof, constitute
an Agreement between the Customer and PI Gear, Inc. (PI Gear) and are referred
to as such:
Controlling
Provisions
The
terms and conditions appearing herein constitute the sole and entire Agreement
of the parties regard less of the timing, for or content of other
communications between the parties, if any, all of which are merged herein. The
Customer and PI Gear agree to abide by all the terms and condition contained
herein with each and every purchase. PI Gear objects to the inclusion of any
different or additional terms, and non additional or conflicting provisions
contained in any other communication from the Customer will be considered an
unconditional acceptance of the terms and conditions appearing hereon, without
regard to any additional or conflicting terms proposed by Customer. None of the
provisions of this Agreement may be varied, amended or modified except by a
written agreement signed by all of the parties.
Local
Laws
Before
ordering any product, you must make local inquiry to determine if the specific
type of product you wish to purchase is permitted to be used or possessed in
your city, state or country. There may be restrictions in your area prohibiting
the purchase, possession, or use of some items listed for sale on our website.
We do not provide for refunds if the product is not allowed to be used or
imported to your location or country or confiscated by any official authority
of any jurisdiction including customs for your country. Again, once the product
you ordered is shipped domestic or internationally, we relinquish any and all
responsibility. If the product is illegal in your jurisdiction, simply don’t
order it as it may never get to you. By placing this order, you accept full
responsibility for all applicable laws, potential loss of product, and accept
the consequences, if any, of this purchase.
PI Gear
accepts all credit cards and PayPal for online purchases from Customer in the
United States. Ground orders made by credit card that are approved will be
normally be processed on the same day so long as the item is in stock. PI Gear
also accepts payment made by Western Union, MoneyGram, and wire transfer with
immediate order processing. Orders accompanied by check will result in a 10-business
day hold to allow sufficient time for the check to clear. International orders
can only be processed Western Union, or bank wire transfer. PI Gear will not
accept credit card payment for international orders. International order may be delayed until
payment clears.

We will BEAT IT or at the very least match it!
We monitor our competitors to
make sure you get the lowest available prices anywhere. However, if you still
find a lower price from another commercial merchant BEFORE you buy that
product, we will gladly match that price to earn your business.
Make sure that you buy from an
established merchant that you can count on being in business months from now.
Also make sure that the products you are buying are not a knock-off or lack a
warranty. PI Gear™ is operated by the owners of PI Magazine ensuring your
purchase can be made with the confidence of their outstanding reputation. We are also licensed private investigators,
not college kids selling equipment to make a few extra dollars. We know, use
and fully understand the capabilities of the equipment we sell.
If you find a lower advertised price, simply email us at [email protected] with
a link to the website page advertising the identical product, including model,
packaging, manufacturer, etc. The price you wish us to match must be
verifiable on the Internet or through an original printed advertisement.
The selected item must be unused, in stock and currently available from a
competitor. The price for comparison should also include the total price,
including the cost of purchase of the same product and quantity, plus any
applicable sales tax, shipping and handling costs. Any special promotions,
discontinued items, free offers, and special payment arrangements are not
eligible for price match.
We are also unable to match any item offered for sale on E-Bay since there is
no way to confirm that they are authentic, in original packaging, or that they
may be used.

Shipping

Shipping
will be made within commercially reasonable time unless a specific delivery
time is currently undetermined by the manufacturer or supplier. All orders are
normally processed for shipment the same business day (M-F) when orders are
received before 3:00 p.m. Eastern Time. Orders received after 3:00 p.m. (M-F)
or on weekends shall be processed the next business day. Next Day requests
shall always mean "next business day" unless specifically requested.
In the event an item is not in stock or no longer available, we reserve the
right to substitute the item ordered with a similar item for the same price.
All shipments are F.O.B. Freehold, New Jersey, unless otherwise required. Most
orders are shipped via UPS Ground or FedEx Ground service. PI Gear, Inc. cannot
use a P.O. Box address for UPS or FedEx delivery. The Customer is responsible
for all applicable shipping and handling fees when requesting overnight,
priority, 2 nd day, 3-day select or Saturday service. All customer requests for
shipment insurance are at the Customer’s expense.
Please note after your order is placed and the shipping priority has been selected by you, we cannot take responsibility for the handling of the package by the carrier and the timeliness of the delivery. All complaints about shipping, deliveries and timeliness should be addressed with the carrier. We will assist you when possible with carrier complaints. Once your order in placed into the shipping stream of the shipper (UPS, FedEx, USPS) uncontrollable delayed may be encountered. PI GEAR will make all reasonable efforts to be certain your order arrives when you need it. Unforeseen shipping delays by the shipper cannot be control by PI GEAR.
Please note after your order is placed and the shipping priority has been selected by you, we cannot take responsibility for the handling of the package by the carrier and the timeliness of the delivery. All complaints about shipping, deliveries and timeliness should be addressed with the carrier. We will assist you when possible with carrier complaints.
All orders will be shipped "NO SIGNATURE REQUIRED" unless the customer specifically requests a signature to complete delivery. PI GEAR reserves the right to require a signature on ANY order. If an order requires a signature, either on the request of the customer OR upon request of PI GEAR, the customer accepts responsibility to accept the delivery. If the delivery cannot be completed for ANY reason including the customer not being available to accept the delivery, and the delivery is returned to PI GEAR or additional fees are incurred by PI GEAR, it shall be the customers responsibility for all fees related to an incomplete delivery for these reason.
It is the responsibility of the customer to ensure a safe delivery location and ensure the proper arrangements for receiving a shipment. If a package is lost, stolen or otherwise removed after delivery, it shall be the responsibility of the customer. No refunds will be issued in these situations for lost, stolen or otherwise missing packages after delivery.

Return
Policy
All
requests for returns, refunds or exchanges must be made within 48 hours of
delivery confirmation by the shipper. PI Gear will replace, refund, or credit
your account for returned item(s) at our discretion. Do not attempt to return
any item(s) until you have received a Return Authorization number (RA#) or we
will not process your refund request. Equipment purchased may only be
returned for a credit or replacement. Any product that has been used in anyway
will not be accepted as a return. All products are tested before
shipment to insure they work properly and are unblemished. Products that were
damaged in transit require that you make a claim directly with the shipping
company as it is not the responsibility of PI Gear, Inc.
PI GEAR
will not accept any item that is purchased, used or "tested" by the
purchaser. It is the buyer’s responsibility to fully research the
item being purchased to be sure it will meet your needs, be appropriate and
legal to use. We are always available to discuss the options available
and will do our best to suggest the appropriate piece of equipment, however, in
the end it is the buyer’s decision on what piece of equipment to
purchase.
In the
unlikely event an item is defective or inoperative upon delivery, a replacement
item or item selected from the applied credit, will not be shipped until the
item in question is returned and evaluated by our tech team.
PI GEAR
will not accept any returns on devices or equipment that has been altered,
disassembled or repairs attempted by ANYONE other than our own technicians. If
you disassemble the device in any manner other then what is required to
change or swap a battery, insert an SD card, or attach an included, authorized
device or attachment, the warranty is automatically voided. No exceptions.

- ANY RETURNS WITHOUT AN RA#
Upon
receiving an RA#, please keep the following in mind:
1. Items damaged in transit are
not the responsibility of PI Gear. Please make a claim with, UPS, FedEx, or the
USPS.
2. Any item to be returned must
be shipped within 5 business days of receipt and must be in new and sellable
condition, (undamaged and in original shrink-wrap). There must be no marks on
the item and the item must not have been used. If any instructions, packaging
or contents are missing customer will not receive any credit at all and the
item will be returned to customer.
3. There are no returns
accepted on any audio or video digital recording devices.
4. There is a 20% restocking
fee for each re-sellable item returned and NO REFUND for shipping charges to or
from customer.
5. Equipment returned with no
RA# may not be accepted for return credit and will be returned to the customer
upon request and at the customer’s expense.
6. PI Gear shall not be
responsible for any shipping charges unless the wrong product was shipped in
error.
7. Special order, sale,
discontinued, or promotional items are not returnable or refundable.
8. Videotapes, audiotapes,
CD’s, DVD’s, and books are non-returnable.
9. Any item that has been used
or modified is non-returnable.
10. Shipping and handling
charges are non-refundable.
11. Customer is responsible for
return postage/shipping fees. Returns must be shipped via an insured carrier.
We suggest UPS to ship your package. Call 1-800-PICKUPS (742-5877) to find a
location near you.
If the
above requirements are met, then the item(s) may be shipped back to us for
store credit.

• It is the customer’s responsibility to ship item(s) in a protective manner in
a shipping box taped and sealed.

• Shipping costs and tracking are the responsibility of the customer
• Items must be returned by a traceable method (i.e. UPS, FedEx, DHL, etc)
• The customer is responsible for the goods until we receive them.
• The RA# must be clearly marked on the outside packaging of the shipping box.

Warranties
All
merchandise distributed by PI Gear, Inc. carries a Ninety (90) Day Limited
Warranty on parts and labor, these items may further be covered when indicated
under the manufacturer’s warranty, a copy of which is available at PI Gear,
Inc. upon written request only. PI GEAR MAKES NO WARRANTY, EXPRESSED OR
IMPLIED, INCLUDING ANY WARRANTY OR FITNESS FOR ANY PARTICULAR PURPOSE OR
MERCHANTABILITY. No agent, employee or representative of PI Gear is authorized
to bind PI Gear to any affirmation, representation, or warranty, oral or
written, unless by separate written instrument designed by PI Gear, which by
its terms state that it is included as part of this sale and agreement.
We will
not accept ANY returns on equipment that has been damaged, altered of have had
attempted repairs performed by anyone other than our own technicians. If
you disassemble the device in any manner other then what is required to
change or swap a battery, insert an SD card, or attach an included, authorized
device or attachment, the warranty is automatically voided.
No
warranty claim will be honored for devices or equipment that has been abused or
damaged by the user in any manner. PI
GEAR reserves the right to inspect any device or equipment returned prior to
issuing a refund or replacement. Buyer
accept email as a suitable method of communication on all claims submitted.
Claims
Receipt
of goods shall be deemed acceptance of the goods received. All claims for
defective goods or revocation of acceptances, for shortages, for delays, or failures
in shipment or delivery, or for any cause shall be deemed waived and released
by the Customer unless it is made in writing within (7) days after receipt of
goods. All claims must state specifically and in reasonable detail the nature
of all objections, and must be accompanied by delivery receipt or photocopy of
the sales order or packing slip. Any delivery not placed in dispute within 10
days of order shall be paid for by the Customer and all uncontested amounts due
shall be paid by the Customer with terms specified. As a condition to making a
claim for missing or damaged goods sent, the Customer is responsible for
initiating and pursuing with the carrier. PI Gear shall not be responsible for
loss of any item ordered should customer request no signature required with
delivery.
Limitation
of Liability
PI
Gear’s liability will be limited to replacement or repair of defective goods
upon receipt of goods in a timely manner per the Return Policy paragraph
detailed herein. In no event will PI Gear be liable for consequential or
special damages or for transportation, installation, removal, adjustment or
other expenses or losses which may arise in connection with the use or
installation of the goods; late delivery, failure to deliver; or from any other
cause. Notwithstanding the terms of this Agreement of sale, if there should
arise any liability of PI Gear, Inc., such liability shall be limited to an
amount equal to one-half (1/2) the costs of the goods or $250.00, whichever is
less.
Errors
and Omissions
Even though
PI Gear makes every effort to insure that all of the information displayed on
the PI Gear website is accurate, complete, and current, it is possible that
information about an item may contain inaccurate or incomplete information,
including information about the item's price or availability. Product names and
photographs may vary. PI Gear reserves the right to correct errors and/or
update the content on our website at any time without notice. PI Gear also
reserves the right to refuse or cancel any order containing any error or
inaccuracy, even when the order has been submitted, whether or not the order
has been confirmed and the Customer’s credit card charged. A full refund will
be issued in the same manner it was paid should the Customer’s order be canceled
after payment has been processed.
Indemnification
Customer
agrees to indemnify and hold harmless PI Gear, Inc., its shareholders,
directors, officers, employees, representatives and agents (collectively,
“Representatives”), all of PI Gear’s affiliates and all Representatives of all
PI Gear affiliates from and against any and all lawsuits, losses, damages,
actions, causes of action, governmental duties, charges, lines, penalties,
costs, expenses or obligations of any kind or nature whatsoever (including
reasonable attorney’s fees and costs of defense) arising, relating to, or
alleged to arise or relate to the actions or inactions of Customer in
connection with this Agreement of sale and/or goods or services to be provided
by PI Gear pursuant to this Agreement. This indemnification obligation shall
survive termination, cancellation or completion of this Agreement.
Assignment
This
Agreement may not be assigned by Customer without the express written consent
of PI Gear, Inc.
Governing
Law
This
agreement shall be governed by the laws of the State of New Jersey and
adjudicated within Cape May County, New Jersey.
Notice
Any
notice or written document required or permitted to be given by Customer or PI
Gear to the other shall be in writing signed by the party giving such notice
and sent to the other party at such other Party’s address set forth on the
front of this Agreement (or such other address designated by the applicable
party).
Severability
If any
provision of this Agreement or the application thereof to any person(s) or
entity(ies) or circumstance(s) shall be invalid or unenforceable to provision,
each such provision shall be enforced to the greatest extent permitted by law.
Disclaimers
Depending
on where you live, restrictions by certain states, counties, and cities may
prohibit the possession or use of some items listed for sale by PI Gear, Inc.
on our website or catalogs. It is solely the responsibility of the Customer and
not the PI Gear, Inc. or PI Gear, Inc. to understand and obey federal, state,
and local laws or ordinances with regard to the purchase, possession, and use
of any product(s) purchased before placing an order. You should contact your
federal, state, and local authorities to be certain you are not breaking any
laws. By placing any order with PI Gear, Inc. you agree; to all the terms and
conditions contained herein; that you are of legal age to purchase and possess
the item(s) purchased; that you have made sufficient inquiry to know that it is
legal for you to purchase and process the items purchased in your jurisdiction;
that the use of the item(s) purchased shall be used in a lawful manner; that
you have read this disclaimer and that by making a purchase from PI Gear Inc.
you agree to hold PI Gear, Inc, its owners, agents, product suppliers, or
affiliates harmless from any and all liability.
